Selling alcohol to an intoxicated person, just like selling alcohol to a minor, is illegal in most countries and all 50 states. While the penalties for violation vary from state to state, they usually include fines and the suspension or loss of liquor license, and they often allow for civil and/or criminal prosecution. The latter has resulted in both jail sentences and single judgments of tens of millions of dollars.

Whereas age is easy to verify objectively, sobriety is not. Since traditional objective sobriety verification methods (bodily-fluid tests) are out of the question in these settings for a whole host of reasons, alcohol selling establishments typically train their sales people in subjective verification techniques. Unfortunately, even competent sales people following procedure will frequently misjudge sobriety, leaving their employer vulnerable.
